Disclaimer
Chpass takes no responsibility for any damages or losses Customer's business may suffer due to use of Chpass products and services. Chpass takes no responsibility for the data and or files contained in Customer's directories; Customer agrees to assume full responsibility for data/files contained in Customer's home directory and all of its subdirectories. Chpass reserves the right to change and or modify its policies at any given time without any prior notice. If Customer violates any terms and conditions, Chpass has the right to deactivate any account on Chpass machines.
Chpass reserves the right to change any policies, prices, or configuration of any and all accounts when deemed appropriate and necessary.
Payments
Chpass will not activate any account ordered by Customer until Customer has paid the first term's fee for that account. Only at the discretion of a Chpass administrator can Customer have Customer's account activated before payment. All first payments must be paid in full, without exception. If your invoices becomes public for any reason, Customer is obligated to notify Chpass. Failure to make timely payments may result in temporary account deactivation. If Customer billing status is delinquent for more than a two week period, Customer's account will be deleted along with all data in the Customer's directories. In this case, Customer may be allowed to retreive any and all data in Customer's directories, but this will be at Chpass discretion. Customers who wish to reactivate a delinquent account will be charged with a reactivation fee of $7.00 and the normal price for the next billing period. Customer is responsible for sending payment on a monthly/quaterly/anually. Chpass will not be reminding them of their due date.
Abuse
Chpass reserves the right to decide what constitutes abuse of any of Chpass machines, personnel, or customers. Chpass reserves the right to refuse service to anyone. Server abuse includes, but is not limited to the following: a) Hacking or cracking any Chpass machines; b) Storage of warez, illegal mp3 music files, pornography, exploits, or any illegal copyrighted content for any purpose; c) Sending unsolicited messages to others, known as spam, for Customer's website, email, dns, or for Chpass; d) Scanning or flooding directed at or from Chpass machines; and e) Transmissions of any material in violation of federal, state, or local regulation. Any material not mentioned above is left entirely to the discretion of the Chpass administration. Server abuse will lead to suspension and/or removal of Customer's account, potential legal prosecution, with no refund owed to Customer.
Early Account Terminations or Suspensions
Chpass reserves the right to suspend any account, for any reason, at any time. Best effort to contact Customer will be made by Chpass before account suspension. Removal of an account may occur 2 days after a suspension. Chpass disclaims any responsibility and warranty for any data contained in Customer's account during the removal of that account. Violations of these policies will represent a breach of your contract with Chpass, resulting in suspension and/or removal of your account from our systems without warning. Anyone who breaches this contract between Customer and Chpass is not subject to a refund, unless specified otherwise by an administrator.
Shell Account Policies
A shell Customer agrees to only use allocated disk space for the software and data being used on Customer's account. Customer agrees that the processes being run on the shell will not connect more than once per process to any IRC Network, with the exception of bouncing software. Customer agrees that software used by Customer is the legal property of the Customer, and that this software will not intentionally cause or be used to cause harm to Chpass, its customers, or the Internet community at large. Customer also agrees that Customer initiated floods, hacking attempts, or any malicious action intended to cause harm to another, for any reas on, is grounds for immediate account suspension/removal and prosecution. Customer may not run greater than allotted processes. Customer may not bind to IP addresses/hostnames that are not public, without expressed permission. Customer may not promote/entice/participate in, or attempt to participate in, denial of service attacks. If Client is found to be receiving denial of service attacks frequently, account may be suspended or terminated, without refund. Customer may not run webcams, shoutcast servers, any type of game server, or any other process that utilizes an unreasonable amount of bandwidth or system resources, without expressed permission.
